Tree Service Terms & Conditions Agreement
Provider: Barone’s Tree Pros, LLC
1. Scope of Work, Deliverables, & Wood Left On-Site
Defined Services: Barone’s Tree Pros, LLC will perform tree removal, tree trimming, and stump grinding as explicitly specified in the written proposal.
Modifications: Any changes, additions, or deviations from the original proposal require a written Change Order signed by both parties.
Cleanup Standard: Tree removal and trimming include removing brush, cutting logs, and raking work areas.
Stump Grinding Limits: Stump grinding can be billed as a separate line item if needed. It includes grinding the stump to a depth of surface level, or 4–8 inches below grade, according to customer preference and utility locations.
Debris Placement: Excess stump grind mulch will be backfilled into the hole, mounded, and left on-site unless haul-away services are explicitly purchased.
Wood & Firewood Requests: If the client requests that logs or wood be left on-site or cut to firewood length, Barone’s Tree Pros, LLC will leave the material as instructed.
Removal of On-Site Wood: If the client later changes their mind or requests the removal of wood previously left on-site, Barone’s Tree Pros, LLC is not responsible for returning to remove it at no cost. Returning to haul away left-behind wood will result in an additional mobilization and removal charge.
2. Permits, Licensing, & City Bonds
Permit Acquisition: Barone’s Tree Pros, LLC will directly obtain any necessary municipal or city tree permits required to legally perform the contracted work.
Bonding Status: Barone’s Tree Pros, LLC maintains active city-specific bonding where required by local municipalities to guarantee compliant permit acquisition and job completion.
3. Client Responsibilities & Site Access
Property Access: Client warrants that all trees specified in the proposal are on their property or that they have legal authority to authorize work.
Work Clearance: Client must clear the work area of vehicles, outdoor furniture, pets, toys, and moveable items before the arrival of the crew.
Neighbor Permission: Client must secure written permission from neighboring property owners if crew equipment must cross adjoining property lines.
Concealed Contingencies: Any additional work or equipment required to complete the work, caused by the authorizing party’s failure to make known or caused by previously unknown foreign material in the trunk, the branches, underground, or any other condition not apparent in estimating the work specified, shall be paid for by the customer.
4. Liability, Heavy Equipment, & Property Damage Waivers
Heavy Equipment: Barone’s Tree Pros, LLC uses heavy machinery (bucket trucks, loaders, track machines, stump grinders, etc.) that can weigh several tons to safely access and remove large trees.
Lawn Ruts & Equipment Marks: Because of the immense weight of this specialized machinery, tire tracks, track marks, or shallow ruts are a common and expected result of operating on lawns, particularly on soft or wet ground. Barone’s Tree Pros, LLC is not liable for lawn ruts, grass or soil depression, or cosmetic turf damage resulting from necessary equipment operation.
Lawn & Driveway Disclaimer: Contractor is not liable for minor, expected cosmetic damage to lawns, driveways, sidewalks, or landscaping resulting from normal equipment operation and/or normal chainsaw use and operation. While the company uses standard operational safeguards, the company is not liable for minor, incidental oil staining on driveways, walkways, or patios located in the work zone (e.g. residual run off of bar and chain lubricant).
Unmarked Utilities: Client is solely responsible for marking all private underground lines (e.g., invisible dog fences, irrigation, septic, landscape lighting, etc.). Any irrigation systems should be turned off at least 48 hours prior to project.
Utility Damage Waiver: Barone’s Tree Pros, LLC is not responsible for damage to unmarked or improperly buried private utilities. Public utilities will be marked via 811.
Concealed Hazards: Barone’s Tree Pros, LLC is not liable for structural damage caused by trees with hidden internal rot, hollow centers, or embedded foreign objects (e.g., fencing, iron pipes, etc.).
5. Insurance & Safety
Coverage Status: Barone’s Tree Pros, LLC maintains active General Liability Insurance to protect against property damage.
Proof of Insurance: Certificates of insurance are available upon written request prior to work commencement.
Safety Zone: Tree work is inherently dangerous. Client, family, guests, and pets must remain completely outside the designated work zone while heavy machinery or chainsaws are operating.
6. Payment Terms, Deposits, & Penalties
Accepted Forms: Payment may be made via credit card, check, cash, or secure online payment links. There is an additional fee for credit/debit cards and links.
Residential Invoices: All residential balances are due immediately upon completion of the specified work.
Commercial Invoices: All commercial accounts are subject to Net 14-30 terms from the date of the invoice, as agreed upon prior to scheduled work.
Upfront Deposits: While upfront deposits are not standard, Barone’s Tree Pros, LLC reserves the right to require a deposit for large-scale projects, to be explicitly negotiated and agreed upon prior to scheduling.
Late Fees: Overdue balances not received within 5 days of completion will accrue fee of 5% of balance and 2.5% interest per month thereafter of the balance due after specified late timeframe or the maximum legal limit, whichever is lower.
Barone’s Tree Pros, LLC can also accrue an additional interest rate of 1.5% per month or 18% per annum, whichever is lower.
Collection Costs: Client agrees to pay all reasonable attorney fees, court costs, and collection agency fees incurred by Barone’s Tree Pros, LLC to recover unpaid balances.
There will be a $40.00 fee assessed for all checks returned to our office for non-sufficient funds or other reasons.
7. Scheduling, Cancellations, & Weather
Contingencies: Tree work is highly dependent on weather conditions. Barone’s Tree Pros, LLC reserves the right to delay or reschedule work due to high winds, heavy rain, lightning, or extreme ground saturated conditions.
Cancellation Fee: Clients must provide at least 48 hours’ notice to cancel or reschedule a project. Cancellations made under 48 hours are subject to a $150 scheduling fee.
Barone’s Tree Pros, LLC agrees to do its best to meet any agreed upon performance dates, but shall not be liable for damages or otherwise for delays due to weather, labor, equipment, or any other cause beyond its control, nor shall the customer be relieved of completion for delays.
